En este caso, el Tribunal mencionado tomó las reglas de reparto contenidas en el Decreto 1382 de 2000 para declararse incompetente y no pronunciarse de fondo.
Considera la Corte que con dicha actuación se afectó la celeridad y eficacia de la administración de justicia, al igual que el amparo de las garantías del accionante.
Se dirime el asunto con la remisión del expediente a la primera autoridad que conoció el asunto, esto es, la Sala Civil-Familia del Tribunal Superior de Barranquilla.

- Primero. DEJAR SIN EFECTOS la decision del 28 de agosto de 2017, mediante la cual resolvio que no era competente para conocer la accion de tutela presentada por el senor Tomas Manuel Ramos Quiroz.
- Segundo. REMITIR el expediente ICC- 3103 al del Tribunal Superior de Barranquilla Sala Civil- Familia para que asuma de manera inmediata y sin dilaciones el conocimiento del asunto de la referencia.
